How Section 8 eligibility works

Rent Cap. A PHA's payment standard is between 90% and 110% of HUD's published Fair Market Rent without special approval, and up to 120% with HUD approval. Your asking rent cannot exceed the rent reasonable comparable for your market, and the PHA reviews each submission.

HAP Formula. The monthly Housing Assistance Payment (HAP) equals the lower of: (payment standard βˆ’ TTP) or (gross rent βˆ’ TTP). The tenant pays the difference between the contract rent and HAP, minimum $0 if HAP covers the full rent.

Rent Reasonableness. Even if your asking rent is at or below the payment standard, the PHA's rent-reasonableness study must show your rent is in line with comparable unassisted units. 24 CFR 982.507.
